Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Apex Trader platform, including the website, applications, and related services (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old and legally able to enter into a binding contract in your jurisdiction. By using the Service you represent that you meet these requirements and that your use complies with all laws that apply to you.

2. What Apex Trader is — and is not

Apex Trader is a software platform that helps you design, test, and operate algorithmic trading strategies and connect your own third-party brokerage accounts. We are not a broker-dealer, exchange, futures commission merchant, investment adviser, or financial institution. We do not hold your funds, do not execute trades as principal, and do not provide personalized investment, legal, tax, or accounting advice. Any signals, analytics, backtests, AI-generated commentary, or other outputs are informational only and are not a recommendation to buy or sell any instrument.

3. Your account

Account creation requires a valid invite code and acceptance of these Terms and the Risk Disclosure. You are responsible for the accuracy of your registration information, for safeguarding your credentials, and for all activity under your account. Notify us immediately of any unauthorized use.

4. Brokerage connections and trading

You may connect third-party brokerage or exchange accounts. You authorize the Service to transmit orders and read account data solely as you direct. You remain solely responsible for every order placed through or on behalf of your account, including orders generated by automated strategies you configure or enable. You are responsible for monitoring your strategies and your positions.

5. Subscriptions and fees

Paid plans, if selected, are billed through our payment processor on the terms presented at checkout. Except where required by law, fees are non-refundable. We may change pricing prospectively with notice.

6. Acceptable use

You agree not to misuse the Service, including by attempting to gain unauthorized access, interfering with its operation, reverse-engineering it, using it for unlawful market activity, or violating the rules of any connected broker, exchange, or data provider.

7. Third-party data and services

The Service displays data from third-party sources (market data, disclosures, news, and others). We do not guarantee the accuracy, completeness, timeliness, or availability of any third-party data, and such data may be delayed or incorrect.

8. Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE, OR THAT ANY STRATEGY OR OUTPUT WILL BE PROFITABLE. SEE THE RISK DISCLOSURE.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR FOR ANY TRADING LOSSES, LOST PROFITS, OR LOSS OF DATA, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE.

10. Indemnification

You agree to indemnify and hold harmless Apex Trader and its operators from any claims arising out of your use of the Service, your trading activity, or your violation of these Terms.

11. Termination

You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or to protect the Service or other users.

12. Changes

We may update these Terms. Material changes will be reflected by a new version date, and continued use after changes constitutes acceptance.

13. Governing law
